Top Gym — General Rules & Policies
1. Membership & Access
- 1.1 Memberships are personal and non-transferable.
- 1.2 Members must use their own valid membership, membership card, QR code or other approved access method when entering Top Gym.
- 1.3 Members must not permit another person to use their membership, QR code or account to access the gym.
- 1.4 Top Gym may request identification where reasonably necessary to verify membership.
- 1.5 Access may be refused where a membership is expired, suspended, unpaid or otherwise invalid.
- 1.6 Guests and day-pass users must comply with the same gym rules as members.
- 1.7 All members are required to provide Top Gym with a valid form of identification and valid proof of address as part of the membership registration process. Top Gym may refuse to activate or continue a membership until the required documentation has been provided.
- 1.8 All memberships are subject to availability and acceptance by Top Gym. The purchase or previous possession of a membership does not guarantee the availability or approval of any future membership.
- 1.9 Membership renewals are also subject to availability and acceptance by Top Gym. An existing or previous member is not guaranteed the right to renew their membership upon expiry.
2. Member Conduct
- 2.1 All members and guests must behave respectfully towards Top Gym staff, trainers, other members, visitors and partners.
- 2.2 Shouting at, threatening, insulting, intimidating, harassing or using abusive language towards staff or other members will not be tolerated.
- 2.3 Fighting, aggressive behaviour, deliberate intimidation or conduct which creates an unsafe or hostile environment may result in immediate removal from the premises and suspension or cancellation of membership.
- 2.4 Members must follow all reasonable instructions given by Top Gym staff relating to safety, hygiene, equipment use or gym operations.
- 2.5 Top Gym reserves the right to suspend or terminate membership for serious or repeated breaches of gym rules.
3. Gym Equipment
- 3.1 Equipment must be used only for its intended purpose and in accordance with any instructions provided by Top Gym.
- 3.2 Members must return dumbbells, weight plates, attachments, mats and other equipment to their designated locations after use.
- 3.3 Members must not deliberately drop or throw weights except where reasonably required for an exercise in an appropriate designated area.
- 3.4 Members should not occupy equipment unnecessarily while resting, using their phone or engaging in extended conversations when other members are waiting.
- 3.5 Members are encouraged to allow others to work in between sets during busy periods where reasonably practical.
- 3.6 Equipment must not be moved between areas without permission from Top Gym staff.
- 3.7 Any damaged, faulty or unsafe equipment should immediately be reported to a member of staff.
4. Hygiene & Cleanliness
- 4.1 Members must maintain appropriate personal hygiene when using the gym.
- 4.2 Members should wipe down equipment after use using the cleaning facilities provided.
- 4.3 Appropriate gym clothing and footwear must be worn when using training areas.
- 4.4 Members must not enter training areas with excessively dirty footwear or clothing.
- 4.5 Members must dispose of rubbish in the designated bins and must not leave bottles, tissues, towels or other personal items around the gym.
5. Towels
- 5.1 Top Gym provides a maximum of one small complimentary gym towel per member per visit.
- 5.2 The small towel provided by Top Gym is intended for use during workouts and is not intended to be used as a bath, shower or sauna towel.
- 5.3 Top Gym does not provide large bath towels, shower towels or sauna towels.
- 5.4 Members who wish to use the showers or sauna must bring their own suitable bath or sauna towel.
- 5.5 Towels provided by Top Gym remain the property of Top Gym and must not be removed from the premises.
- 5.6 Additional small towels will not normally be provided. Any exception is at the discretion of Top Gym management.
- 5.7 Repeated misuse, excessive use or removal of Top Gym towels may result in a warning, restriction of towel privileges or other appropriate action.
6. Changing Rooms, Showers & Saunas
- 6.1 Members must respect the privacy of others at all times within changing rooms, showers and sauna areas.
- 6.2 Photography and video recording are strictly prohibited inside changing rooms, showers, toilets and sauna areas.
- 6.3 Members must use sauna facilities responsibly and comply with any safety notices displayed.
- 6.4 Appropriate hygiene must be maintained before entering sauna facilities.
- 6.5 Members should not place personal belongings in a manner that obstructs walkways, benches, showers or other members.
- 6.6 Lockers are provided for temporary use while attending the facility unless otherwise stated.
- 6.7 Members should not leave valuables unattended. Top Gym is not responsible for loss, theft or damage to personal belongings except where liability cannot legally be excluded.
7. Classes
- 7.1 Classes are subject to availability, capacity and scheduling.
- 7.2 Members should arrive before the scheduled class start time.
- 7.3 Late admission may be refused where entering the class would disrupt the session or create a safety risk.
- 7.4 Members who book a class but cannot attend should cancel their booking as early as reasonably possible.
- 7.5 Top Gym may introduce reasonable cancellation or no-show restrictions where members repeatedly reserve spaces and fail to attend.
- 7.6 Members must follow the instructor's directions during classes.
- 7.7 The instructor may refuse participation where they reasonably believe that participation would create a safety risk.
8. Personal Training
- 8.1 Personal training sessions must be arranged through Top Gym or authorised Top Gym trainers unless management has expressly approved otherwise.
- 8.2 External or unauthorised personal trainers are not permitted to conduct paid training sessions within Top Gym.
- 8.3 Members must comply with the applicable cancellation and rescheduling policy for personal training sessions.
- 8.4 Members remain responsible for informing their trainer of any relevant limitations or concerns before participating in training.
9. Filming, Photography & Social Media
- 9.1 Personal photography and filming may be permitted within training areas provided it does not interfere with other members or gym operations.
- 9.2 Members must respect the privacy of other individuals and should avoid intentionally filming other members without their consent.
- 9.3 Large filming setups, professional photography, tripods, lighting equipment or commercial filming require prior approval from Top Gym management.
- 9.4 Filming is strictly prohibited in changing rooms, toilets, showers and other private areas.
- 9.5 Top Gym may require filming to stop where it creates a safety hazard, significantly inconveniences other members or interferes with gym operations.
10. Food & Drinks
- 10.1 Drinks should be kept in suitable closed containers while on the gym floor.
- 10.2 Glass containers are not permitted within training areas.
- 10.3 Food should generally be consumed only in designated areas, including the café or other approved spaces.
- 10.4 Members must immediately report significant spills or broken containers to staff.
11. Health & Safety
- 11.1 Members use Top Gym facilities and participate in exercise according to their own abilities and at their own risk, subject to applicable law.
- 11.2 Members should obtain appropriate medical advice before undertaking exercise where they have concerns regarding their ability to participate safely.
- 11.3 Members must immediately inform staff of accidents, injuries, hazards, spills, damaged equipment or other safety concerns.
- 11.4 Members must not use equipment while intoxicated or while impaired by alcohol, illegal drugs or any other substance that makes exercise unsafe.
- 11.5 Emergency exits, fire equipment, corridors and access routes must not be obstructed.
12. Children & Minors
- 12.1 Access by children or persons under the applicable minimum age is subject to Top Gym's age requirements and management approval.
- 12.2 Where minors are permitted within the facility, they must comply with any supervision requirements imposed by Top Gym.
- 12.3 Children must not be left unsupervised in training areas where doing so may create a safety risk.
13. Personal Belongings
- 13.1 Members remain responsible for their personal belongings while at Top Gym.
- 13.2 Valuable items should not be left unattended.
- 13.3 Top Gym is not responsible for lost, stolen, forgotten or damaged personal items except where liability cannot legally be excluded.
- 13.4 Items left at the gym may be placed in lost property and may be disposed of after a reasonable period if unclaimed.
14. Smoking & Prohibited Items
- 14.1 Smoking, vaping and the use of similar products are prohibited inside Top Gym except within any specifically designated permitted area.
- 14.2 Illegal drugs, weapons and dangerous or prohibited items are not permitted within the facility.
15. Damage to Property
- 15.1 Members may be held responsible for damage caused intentionally, recklessly or through misuse of Top Gym equipment, facilities or property.
- 15.2 Top Gym may require reimbursement for reasonable repair or replacement costs resulting from such damage.
16. Membership Freezing, Suspension & Expiry
- 16.1 Membership freezing is available only where included within the relevant membership package or specifically approved by Top Gym.
- 16.2 Freeze periods must comply with the applicable membership terms.
- 16.3 Membership access automatically ends or becomes inactive once the membership expires unless renewed.
- 16.4 Membership benefits, including access to facilities, classes or partner benefits, are available only while the relevant membership remains active unless otherwise stated.
17. Top Gym App & QR Code
- 17.1 Members must keep their Top Gym account and QR membership credentials secure.
- 17.2 QR codes and membership credentials may not be shared with another person.
- 17.3 Any misuse or attempted misuse of membership credentials may result in access being suspended.
- 17.4 Certain services, benefits, class bookings, partner offers or membership verification may be provided through the Top Gym App.
- 17.5 Availability of App functions may occasionally be interrupted for maintenance, technical issues or system updates.
- 17.6 The price and value of a Top Gym membership are independent of the Top Gym App and any benefits, features, offers, discounts, partner privileges or other services made available through the App. Such App features and benefits are supplementary to the membership and do not form part of the calculation or determination of the membership price or value. The modification, suspension, withdrawal or unavailability of any App feature or benefit shall not entitle a member to any refund, reduction, credit or adjustment to the price of their membership.
18. Partner Benefits & Third-Party Facilities
- 18.1 Top Gym may provide members with access to offers, discounts or benefits provided by independent third-party partners.
- 18.2 Unless expressly stated otherwise, any goods, services, food, beverages, treatments, facilities or other services supplied by a partner are provided directly by that partner.
- 18.3 The member is responsible for all charges incurred directly with the partner.
- 18.4 Top Gym does not guarantee payment by members to any partner and is not responsible for disputes relating to payments, refunds, services or products provided directly by a partner.
- 18.5 Top Gym is not responsible for the conduct or behaviour of a member while the member is using a partner's premises, products, services or facilities.
- 18.6 Partners may apply their own reasonable rules, booking requirements, restrictions and terms of service.
19. Commercial Activity
- 19.1 Members may not conduct unauthorised commercial activities within Top Gym.
- 19.2 This includes unauthorised personal training, product sales, solicitation of members, distribution of promotional material or promotion of competing businesses.
- 19.3 Any commercial photography, marketing activation, event or promotional activity requires prior written approval from Top Gym management.
20. Respect for Staff Decisions
- 20.1 Top Gym staff are authorised to enforce these policies.
- 20.2 Where a member disagrees with a staff decision, the matter should be raised respectfully with management.
- 20.3 Abusive, aggressive or threatening behaviour towards a staff member because they are enforcing a Top Gym policy will not be tolerated.
21. Suspension or Cancellation of Membership
Top Gym may issue a warning, temporarily suspend access or cancel a membership where a member:
- repeatedly breaches Top Gym policies;
- abuses or threatens staff or other members;
- engages in violent, dangerous or seriously disruptive behaviour;
- intentionally damages property;
- shares or misuses membership access;
- conducts unauthorised commercial activities;
- commits theft or other unlawful behaviour; or
- otherwise seriously interferes with the safe or proper operation of the facility.
Where appropriate, Top Gym may immediately remove or suspend a member without first issuing a warning where the conduct is sufficiently serious.
21.1 Three complaints made against a member by members, Top Gym staff or Top Gym management, whether arising from one incident or from multiple separate incidents, will result in the immediate termination of that member's membership without refund.
22. Changes to Gym Rules
Top Gym may reasonably amend these policies from time to time to reflect operational, safety, legal or service requirements.
Updated policies may be communicated through the Top Gym App, website, reception, email, signage or other reasonable means.
23. General Principle
Top Gym aims to provide a premium, welcoming and respectful environment.
Members are expected to:
- Respect the gym.
- Respect the equipment.
- Respect the staff.
- Respect each other.
